    On 30 June 2017, a Gateway Determination was issued by the Department of Planning and Environment recommending that the Planning Proposal progress, subject to conditions.

    The conditions include:
    • The Planning Proposal is to be updated:
    (a) to demonstrate consistency with Section 117 Direction 4.3 Flood Prone Land; and
    (b) to address the flooding concerns raised by Northern Beaches Council in its submission dated 30 March 2017, including proposed cut and fill on the site, implications for on-site flood behaviour, potential flood impacts up and downstream of the site and flood emergency response which caters for flood events up to the Probable Maximum Flood level.

    The updated Planning Proposal is to be submitted to the Department of Planning and Environment for review and approval prior to community consultation.

    • Consultation is required with the following public authorities:
    - Northern Beaches Council
    - State Emergency Service (SES)
    - Office of Environment and Heritage
    - Sydney Water
      Each public authority is to be provided with a copy of the Planning Proposal and any relevant supporting material, and given at least 21 days to comment on the proposal.

        The applicant requested a Rezoning Review and on 12 April 2017, the Sydney North Planning Panel found that the Planning Proposal should be progressed and submitted for a Gateway Determination based on both strategic and site specific merit of the Proposal, subject to the information currently lacking from the application be provided by the applicant.

        Following the determination, the original Planning Proposal and additional information will be placed on public exhibition in accordance with the requirements of the ‘Gateway determination’ issued by the Minister (or delegate).

        Council is seeking public comment on this proposal prior to an assessment of the application being reported to Council. The application seeks to amend the Pittwater Local Environmental Plan 2014 to increase the permitted dwelling yield from 0 dwellings to 22 dwellings.

        The proposal and relevant documents can be viewed between Monday 28 November 2016 and Tuesday 13th December 2016 at Council’s Customer Service Centres at 1 Park Street, Mona Vale, 725 Pittwater Road, Dee Why and 1 Belgrave Street, Manly during business hours, and at www.pittwater.nsw.gov.au/tracking, searching for application PP0003/16.

        Any person may make a written submission. This must be addressed to the Interim General Manager, marked with the application number and must be submitted by Tuesday 13th December. These will be taken into account during the assessment process, provided they are relevant to the application. If required, submissions must be accompanied by a Political Donations and Gifts Disclosure Statement which can be downloaded at www.pittwater.nsw.gov.au/forms.
