Planning Proposal - Increased Floor Area for Secondary Dwellings

Consultation has concluded

We are proposing to amend the Warringah Local Environmental Plan 2011 (WLEP2011) to allow an increase in the maximum size of secondary dwellings from 60 square metres to 75 square metres only when constructed within an existing dwelling house.

In accordance with the Gateway Determination granted by the Minister for Planning for this proposal, delegation has been granted to the Council for the making of the amendments to WLEP2011.

    On 6 May 2016, the New South Wales Government notified the making of Warringah Local Environmental Plan 2011 (Amendment No 16). This implemented Planning Proposal - Increased Floor Area for Secondary Dwellings.

    On 6 May 2016, the New South Wales Government notified the making of Warringah Local Environmental Plan 2011 (Amendment No 16). This implemented Planning Proposal - Increased Floor Area for Secondary Dwellings.

    Council resolved at its 22 March 2016 meeting to instruct the NSW Parliamentary Counsel’s Office to draft and finalise amendments to Warringah Local Environmental Plan 2011. The amendments will give effect to the Planning Proposal to increase the maximum permissible floor area of Secondary Dwellings in existing dwelling houses in R2 and R3 zones to 75 sqm. Council has provided that instruction on 1 April 2016.

    This Planning Proposal seeks to amend Warringah Local Environmental Plan 2011 (WLEP 2011) to allow Secondary Dwellings with floor areas up to 75 square metres, when constructed within existing dwellings. The change would allow for development of two bedroom Secondary Dwellings to accommodate a greater range of household types. This Planning Proposal does not change floor space limits for other types of Secondary Dwellings.

    Secondary Dwellings are permitted by State Environmental Planning Policy - Affordable Rental Housing (SEPP Affordable Rental Housing), which sets requirements for this type of development. This includes the maximum floor area, which is set at 60 square metres, the typical size of a single bedroom residence. While this housing type is suitable for individuals or couples, it may not address the needs of others that require affordable housing choices.

    In 2014, Council undertook a review of the viability of allowing this type of development. This review found that that the increase could be limited to development within existing homes, allowing for the benefits of increased floor areas without increasing the overall size of the existing home.

    On 25 November 2014, Council resolved to prepare a Planning Proposal to increase the maximum floor area for Secondary Dwellings located within an existing dwelling house to 75 square metres.

    On 27 November 2015, the Department of Planning and Environment issued a Gateway Determination for the Planning Proposal. The Gateway Determination directs Council to place the Planning Proposal on public exhibition for a period of 28 days. It also authorises Warringah Council to exercise the functions of the Minister for Planning under section 59 of the Environmental Planning and Assessment Act (1979). This delegates the Minister’s plan making powers to Council for this Planning Proposal.
