Notice of Proposed Temporary Easement to Drain Water over parts of Council land known as 100 Dove Lane, 13 Fern Creek Road and 2-50 Callistemon Way, Warriewood

Under Section 47 of the Local Government Act 1993, Northern Beaches Council is giving notice of its intention to consider granting a temporary easement to drain water, 3 meters wide with an area of approximately 156sqm, to the current adjoining owners of 6 and 6A Orchard Street (Lot C DP 367229 and Lot 102 DP 1033854) over parts of Council Community Land, known as:

  • Lot 3 DP 1251955 (100 Dove Lane, Warriewood)
  • Lot 13 DP 1092788 (13 Fern Creek Road, Warriewood)
  • Lot 8 DP 1092802 (2-50 Callistemon Way, Warriewood).

The purpose of formalising a temporary easement is to enable the construction of an underground stormwater drainage pipe within the Council Reserves.

The granting of the proposed temporary easement is subject to Council approval. Payment of compensation to Council for the creation of the easement is in accordance with Council’s Fees and Charges or valuation (whichever is greater).

The proposed temporary easement will be extinguished when Council’s permanent drainage infrastructure is built. This infrastructure is required under the Voluntary Planning Agreement over 100 Dove Lane, and should occur within the next 5 years. The proposed easement, which is associated with an existing consent on 6 Orchard Road, predates the Voluntary Planning Agreement and is required because construction works at 6 and 6A Orchard Road are due to commence prior to Council’s installation of the permanent drainage system.
