Prior to any development construction taking place we require a security (bond) from owners, developers. These funds are used to complete works or repair damage caused to our infrastructure (kerb and gutter, stormwater, footpaths) during construction when the applicant fails to do so in an appropriate time frame.

The security deposit process varied across the Local Government Area, and required harmonising to provide a single approach to collecting and refunding security deposits.

The policy was placed on public exhibition between 30 October 2020 and 15 January 2021 and received two submissions.

The Development Construction Security Deposit Policy was adopted at the Council Meeting held on 23 March 2021.

One policy for security deposits

The policy will apply across the whole Local Government Area and will give force to Council’s Development/Construction Security Deposit Guideline.

The draft policy features include:

  • legislative framework
  • outlines applicability
    - Development Approvals, Complying Development Certificates, Roads Act approvals and Local Government Act approvals.
  • process for determining security applicable
  • process for recording existing infrastructure condition
  • process for determining refund.
