NSW Government's proposal
The Department of Planning and Environment is currently exhibiting their draft Northern Beaches Aboriginal Land Development Delivery Plan (DDP) for six (6) sites owned by the Metropolitan Local Aboriginal Land Council (MLALC) in the Northern Beaches Local Government Area (LGA).
Note that State Environmental Planning Policy (Aboriginal Lands) 2019 (ALSEPP) was repealed 1 March 2022. The provisions within the ALSEPP are now incorporated within Chapter 3 of the State Environmental Planning Policy (Planning Systems) 2021 (PSSEPP – Chap 3). Any reference within Council’s submission to the ALSEPP therefore refers to PSSEPP – Chapter 3.
The NSW Government documents were on public exhibition until 21 March 2022.

We recently provided the community with an opportunity to comment on our draft submission to the Department of Planning and Environment relating to this proposal.
Council at its meeting held Tuesday 22 March 2022 endorsed the Northern Beaches Council Submission to the draft Development Delivery Plan for Metropolitan Local Aboriginal Land Council on the Northern Beaches.
The Department of Planning and Environment has employed an independent Planning consultant to review submissions and prepare a report to the Minister for Planning and Homes.
The Minister could choose to make amendments to State Environmental Planning Policy (Planning Systems) 2021 to implement the Development Delivery Plan as exhibited.
Alternatively the Minister could determine not to make the amendments and/or request further reports or studies be undertaken before further consideration is given to the matter.
There is no obligation on the Minister to consult further before making his decision.
