Agreement approved

On 30 August 2021, Council received an offer to enter into a Planning Agreement at 3 Central Road, Avalon Beach. The agreement is a required condition of development approved at this site.

The draft Planning Agreement, prepared by Council and Avalon Central, proposes to dedicate land 1m wide to Council free of charge. This land, adjoining the western boundary of Patterson Lane, will widen the Patterson Lane reserve to accommodate the 1.5m wide footpath being constructed as part of the development consent DA2020/0008.

Council resolved to publicly exhibit the draft Planning Agreement and Explanatory Note at the meeting held on 22 March 2022. The exhibited documents can be read in the Council Report (Item 12.1, pg. 112) and draft Planning Agreement and Explanatory Note (Item 12.1, pg. 496).

The draft Planning Agreement (VPA2021/0003) was publicly exhibited from Friday 25 March until Sunday 1 May 2022. We received 10 submissions during the exhibition.

At the meeting held on Tuesday 24 May 2022 Council agreed to enter into the planning agreement.

Dedication of land plan

Dedication of land plan 3 Central Road, Avalon Beach

A Development Application (DA) was approved in December 2020 to build a three-storey seniors housing development at 3 Central Road, Avalon Beach. Refer DA2020/0008.

The approval was given with a Deferred Commencement Condition 1, requiring the developer to enter into a planning agreement with Council to dedicate land 1m wide adjoining the western boundary of Patterson Lane to Council, free of cost.

On 30 August 2021, Council received an offer to enter into a Planning Agreement and a draft Planning Agreement document.

The draft Planning Agreement seeks to facilitate the dedication of land, 1m wide adjoining the western boundary of Patterson Lane, Avalon Beach, to Council. The offer, if approved, will satisfy the requirement set out in Deferred Commencement Condition 1.

The land, to be dedicated to Council, will contain a section of a newly-constructed footpath 1.5m in width. The dedication of land will not occur until this footpath has been constructed by the developer.
