Agreement approved

Council received an offer to enter into a Planning Agreement at 321-331 Condamine Street, Manly Vale. The agreement is a required condition of development consent.

The consent also required the developer to reconstruct and widen Somerville Place to provide a 6m-wide road reserve adjacent to the site. A Planning Agreement is the legal mechanism required to facilitate the dedication of land containing the widened road to Council.

On 11 February 2022 the DA2020/0824 was approved for the demolition of existing structures and construction of a four-storey shop-top housing development consisting of four retail tenancies on the ground floor, 26 residential apartments over three levels and a basement carpark for 43 vehicles.

The Planning Agreement will provide the following benefits, at no cost to Council:

  • Dedication of 54.6m2 of land to Council for the widening of Somerville Place. The dedication will occur after the developer has constructed the widened road.
  • Creation of an easement for public access over a privately owned footpath adjacent to Somerville Place.

Council resolved to publicly exhibit the draft planning agreement at the meeting held on 28 March 2023.

The draft planning agreement was exhibited from 3 April until 7 May 2023. During the exhibition period, 1,074 people viewed the project and one submission was received.

At the meeting held on Tuesday 27 June 2023 Council agreed to enter into the planning agreement.
