Project update: October 2024
Council is renewing the licence of Council community land adjoining 316 Hudson Parade, Clareville (Lot 2 DP 827733). The purpose of the licence agreement is for use as a part boatshed and access stairs.
Following consultation with our community and adoption of the Plan of Management, we sought consent from the Minister for Local Government to enter into the licence agreement, and the Minister has granted consent
Council has entered into a 20-year licence agreement with the owner of the adjoining property at 316 Hudson Parade, Clareville, for the purpose of a part boatshed and access stairs.
We gathered community feedback on this proposal between 27 August 2020 and 24 September 2020 and received 45 online submissions. Thank you to everyone who provided feedback.
Following two reports to Council, we applied to the Minister for Local Government for consent to issue the licence. However, we were advised a Plan of Management would be required before a licence could be issued.
A draft Plan of Management (PoM) was developed, and includes provisions that enable Council to grant a licence to the owner of the adjoining property at Lot 1, 316 Hudson Parade (Lot 1) to construct and use a boatshed and to use the access stairs to the boatshed on the Site.
The draft PoM was exhibited early 2024, and the outcomes were reported to Council, who resolved to adopt the Plan of Management.

At the meeting on Tuesday 26 October 2021, Council resolved to apply to the Minister for Local Government for consent to grant the proposed licence, noting the objections received to the licence.
Under the Local Government Act 1993, it is a requirement that Council applies for the Minister’s consent where objections are received. Should the Minister provide consent, the licence is also subject to the granting of a development consent in respect of DA2020/1762.

At the Council Meeting held on 27 April 2021, Council resolved that the item be deferred.

Council is formalising renewal of an agreement to use an existing area of Community land with the owner of the adjoining property at 316 Hudson Parade, Clareville, under Section 46 of the Local Government Act, for the purpose of a part boatshed and access stairs.
On 7 March 2016, former Pittwater Council resolved to renew the agreement including re-categorisation of the land (Lot 2 DP 827733) from Natural Area to General Community Use. As per the resolution, the land has now been re-categorised to General Community Use and Council is preparing the terms and conditions of the proposed new agreement for this use, which will be a licence agreement rather than a lease agreement.
In accordance with Section 47 of the Local Government Act 1993, Northern Beaches Council gave notice of its intention to consider granting renewal of a twenty (20) year licence to T B Walls to use 58 sq m (approx.) of Council Community land known as whole Lot 2 DP 827733 and located adjoining 316 Hudson Parade, Clareville. The purpose of the licence agreement is for use as a part boatshed and access stairs.
