    At its meeting on 27 March 2018, Council considered a report that dealt primarily with a Gateway Determination for the Oxford Falls Valley and Belrose North Planning Proposal that was received from the NSW Department of Planning & Environment (DPE) in November of last year.

    This Gateway Determination requires Council to, amongst other things:
    • complete a detailed review of the future urban development potential of four sites in the Deferred Lands (Oxford Falls West, Red Hill, Lizard Rock, and Cromer Golf Club), and
    • further examine the environmental significance of land proposed to be zoned E4 – Environmental Living, and
    • amend the Planning Proposal having regard to those investigations prior to undertaking any further community consultation.
    Because these requirements were inconsistent with previous agreements between Council and the DPE, the report to Council recommended that the Planning Proposal not proceed.
    At last week’s meeting, Council resolved to request the Minister for Planning to determine that the Planning Proposal for Oxford Valley Falls and Belrose North should not proceed.

    In response to the Oxford Falls Valley and Belrose North Planning Proposal submitted by Council, the NSW Department of Planning & Environment (the Department) issued a Gateway Determination on 1 November 2017.

    The Gateway determination requires Council to, amongst other things -
    • complete a detailed review of the future urban development potential of four sites in the Deferred Lands (Oxford Falls West, Red Hill, Lizard Rock, and Cromer Golf Club),
    • further examine the environmental significance of land proposed to be zoned E4 – Environmental Living, amend the Planning Proposal having regard to those investigations prior to undertaking any further community consultation.
    This matter will be the subject of a report to Council in the upcoming months.

  • Submission to the Department of Planning and Environment

    On 15 April 2015 Council submitted the Oxford Falls Valley and Belrose North Planning Proposal to the NSW Department of Planning and Environment (the Department) for a Gateway Determination.

    The preparation and submission of the Planning Proposal to the Department is in line with Council’s resolution on 24 February 2015 and the Department’s direction on 23 January 2015.

    The Planning Proposal can be viewed via the LEP Tracking System on the Department’s website.

    On 15 April 2015 Council submitted the Oxford Falls Valley and Belrose North Planning Proposal to the NSW Department of Planning and Environment (the Department) for a Gateway Determination.

    The preparation and submission of the Planning Proposal to the Department is in line with Council’s resolution on 24 February 2015 and the Department’s direction on 23 January 2015.

    At the Council meeting on 24 February 2015, Council resolved the following (voting 6/4):

    That Council:

    A. Endorse the preparation and progression of a Planning Proposal for deferred land under

    Warringah Local Environmental Plan 2011 in accordance with the attached Department’s

    Proposed Zoning Map.

    B. Staff work with the Department prior to submitting the Planning Proposal for Gateway

    Determination, to develop the additional permitted uses and objectives for the E4 zone.


    At the Council meeting on 24 February 2015, Council resolved the following (voting 6/4):

    That Council:

  • Update: Direction from the NSW Department of Planning and Environment

    On 23 January 2015, the NSW Department of Planning and Environment responded to Council’s resolution of 26 August 2014 with a clear direction that a Planning Proposal be submitted by Council based on Option 2, subject to replacing the proposed RU4 Primary Production Small Lot zoned land in Oxford Falls Valley with the E4 Environmental Living zone.

    The Department's request will be reported to Council on 24 February 2015. The Council Meeting agenda containing a report on this will be available on Council’s website from 18 February 2015.

    If a Planning Proposal progresses to a Gateway Determination, the proposal will be placed on Public Exhibition and the community will have further opportunity to make a submission regarding this proposal.

    1. That Council notes:

    A. That Council staff have consistently followed the methodology determined by the NSW Department of Planning and Environment.

    B. The conflicting advice it has received from the NSW Department of Planning and Environment and from the former Minister.

    C. The residents’ concerns regarding the review of their individual parcels of land by the NSW Department of Planning and Environment led team.

    D. That the previous Council was in favour of Stage 2 of the Planning and Assessment Commission recommended studies being carried out immediately.

    E. That the E3 zone is being reviewed by the NSW Department of Planning and Environment.


    2. That Council:

    A. Requests the NSW Department of Planning and Environment to consider the report which is Item 8.1 on tonight’s agenda and make a determination by selecting one of the five options.

    B. Recommends the renaming of the E3 zone to address public concern about the implications of having a zone entitled “Environmental Management”.

    C. Recommends that Stage 2 of the Planning and Assessment Commission recommended studies be carried out immediately by the State Government.

    D. Expresses its concern to the State Government at the rising costs of unnecessarily administering two Local Environmental Plans.

    E. Informs affected landowners of this resolution.

    Council’s resolution has been forwarded to the NSW Department of Planning and Environment for their action.

    As part of Stage 1 of the Strategic Review, Council has sought an independent public hearing and opinion from the Warringah Development Assessment Panel (WDAP) as to the most appropriate land use controls (under Warringah Local Environmental Plan 2011 (WLEP2011)) for deferred land in Oxford Falls Valley and Belrose North.

    The next step will be a Report to Council, requesting a determination on how to bring the land into the WLEP2011.
